1. Agreement

These Terms & Conditions (“Terms”) govern your use of Kiarra AI, a service operated by BCO Agency. By accessing or using Kiarra, you agree to these Terms.

2. Services Provided

​

Kiarra AI offers intelligent chatbot systems, automations, and digital integrations to assist businesses with lead generation, support, and engagement.

​

BCO Agency reserves the right to update or modify features as needed.

​

3. Subscription & Payment

​

• All subscriptions are billed monthly or annually as selected.

• A valid payment method must be maintained at all times.

• The Starter Plan includes a 7-day free trial before the first payment is processed.

• Professional and enterprise setups require upfront setup fees before deployment.

• Prices are listed in AUD or USD (as shown) and exclude applicable taxes.

4. Setup & Implementation

​

Upon signup, clients agree to provide all necessary business information for chatbot setup.

The Kiarra AI team will complete training and deployment within the estimated timeframe (usually 1–10 business days depending on plan).

5. Acceptable Use

​

You agree not to:

​

• Misuse or exploit Kiarra AI for illegal, harmful, or misleading purposes.

• Reverse-engineer, resell, or copy parts of the system.

• Train the chatbot on sensitive personal or confidential data not intended for public use.

6. Third-Party Tools & Integrations

​

Kiarra AI integrates securely with third-party services like Zapier, OpenAI, HubSpot, Google, and other tools.
By using these integrations, you agree to their respective Terms of Service and Privacy Policies.
BCO Agency is not responsible for data misuse or downtime caused by third-party services.

7. Intellectual Property

​

All materials, branding, text, and designs within Kiarra AI are owned by BCO Agency Pty Ltd.

Users retain rights to their business data but grant Kiarra AI permission to process it for chatbot functionality and performance improvements.

8. Limitation of Liability

​

Kiarra AI and BCO Agency are not liable for any indirect, incidental, or consequential damages arising from use of the Services.

In no event shall liability exceed the total amount paid within the last 3 months of service.

9. Termination

​

Users may cancel their subscription anytime. BCO Agency may suspend or terminate access for non-payment, policy violations, or misuse.

​

10. Confidentiality

​

All business data provided for chatbot training remains confidential and will not be shared, sold, or used beyond its intended purpose.

11. Compliance & Data Protection

​

Kiarra AI operates under GDPR, SOC 2, and other applicable data protection standards.
BCO Agency ensures all integrations maintain equivalent levels of security and compliance.

12. Governing Law

​

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in NSW courts.

​

13. AI Accuracy and Client Responsibility

​

Kiarra AI provides automated responses, quotes, and scheduling features based on data, configurations, and integrations supplied by the client.

While we take all reasonable measures to ensure accuracy, BCO Agency and Kiarra AI do not guarantee that all automated calculations, bookings, or responses will be error-free or up to date.

The client is responsible for:

​

• Reviewing and approving all automated outputs where accuracy is critical (e.g. pricing, scheduling, availability).

• Ensuring data and integrations (such as calendars, CRMs, pricing systems) are correctly maintained and updated.

• Informing their customers that they are interacting with an AI system where applicable.

​

BCO Agency will not be held liable for errors, omissions, or losses arising from inaccurate data, misconfigured automations, or third-party platform behaviour.​

14. Disclaimer

​

Kiarra AI is developed by BCO Agency. While designed to help businesses improve performance, results may vary. All ROI and conversion figures are illustrative only. Kiarra integrates with third-party platforms such as Zapier and OpenAI; users are responsible for compliance with their own data and privacy requirements. Learn more
